ELAQUENCE DAY CARE CENTER OPENED APPROXIMATELY AROUND 1988 SERVING DISADVANTAGED CHILDREN & FAMILIES WITHIN THE COMMUNITIES OF BUFFALO, NEW YORK. THE CENTER WAS CENTRALLY LOCATED IN THE BAILEY/KENSINGTON AREA, EMPLOYING APPROXIMATELY 50 QUALIFIED STAFF WORKERS. THE DAY CARE WAS LICENSED BY THE NYS OFFICE OF CHILDREN & FAMILY SERVICES, WITH A LICENSE CAPACITY FOR 40 CHILDREN.
THE DAY CARE WAS ALSO CONTRACTED WITH THE ERIE COUNTY DEPT. OF SOCIAL SERVICES.
ELLA QUINN WAS OWNER AND DIRECTOR OF A SUCCESSFUL DAY CARE.
BETWEEN 1988-1998, THE ELAQUENCE DAY CARE MAINTAINED PROMINENT STATUS WITH THE NYS OFFICE OF CHILDREN & FAMILY SERVICES (BUFFALO REGIONAL AREA)
EVENTS LEADING TO CONSPIRACY:
IN 1999, THE ELAQUENCE DAY CARE CENTER FILED A FORMAL COMPLAINT AGAINST THE NYS OFFICE OF CHILDREN & FAMILY SERVICES' MONITOR/LICENSOR, MARY WALEK FOR INEFFECTIVE MONITORING. NYS CHILD & FAMILY SERVICES TOOK ACTION BY REMOVING MS. WALEK,(LICENSING MONITOR)FROM FUTURE INSPECTIONS OF ELAQUENCE DAY CARE CENTER. MS. WALEK WAS REPLACED BY HER SUPERVISOR, PATRICIA HARPER....(TRUTH OF THE MATTER, THIS COMPLAINT TARNISHED THE RELATIONSHIP BETWEEN ELAQUENCE & THE NYS OCFS.)
ON FEBRUARY 7, 2002... THE INITIAL CONSPIRACY BEGAN WHEN AN ACCIDENT OCCURRED WITH ONE OF THE DAY CARE VOLUNTEER DRIVERS. THIS INCIDENT RECEIVED NEGATIVE MEDIA & PUBLIC HUMILIATION.
ON FEBRUARY 8, 2002.... THE NYS OFFICE OF CHILDREN & FAMILY SERVICES, SUPERVISOR, PATRICIA HARPER TOOK IMMEDIATE ACTION TO ILLEGALLY SHUT THE DAY CARE CENTER DOWN, WITHOUT ANY LEGAL INVESTIGATION OR HEARING.
THE BEGINNING OF MARCH 2002,.... THE ELAQUENCE DAY CARE CENTER TOOK THEIR MATTERS TO THE NYS SUPREME COURT, NOT SURPRISED, THE JUDGE RE-OPENED THE CENTER IMMEDIATELY, OVERTURNING THE NYS OFFICE OF CHILDREN & FAMILY SERVICES' DECISION.
MARCH 2002.... NYSOCFS HARASSMENT BEGAN AND WAS ORCHESTRATED BY SUPERVISOR, PATRICIA HARPER. (5-8 INSPECTORS WOULD VISIT THE DAY CARE CENTER AT ONE TIME, FROM VARIOUS ENTRANCES OF THE FACILITY. THIS ROUTINE CONTINUED ALMOST EVERYDAY THE ENTIRE YEAR UNTIL THE CHILDCARE FACILITY CLOSED).
APRIL 2002,..... NYSOCFS SUPERVISOR, PATRICIA HARPER UTILIZED OTHER AGENCIES TO SEEK OUT VIOLATIONS AT THE CENTER. (NATIONAL FUEL, NATIONAL GRID, CITY OF BUFFALO BUILDING INSPECTORS, CITY OF BUFFALO FIRE CHIEF, & ERIE COUNTY DEPT. OF SOCIAL SERVICES INVESTIGATORS, LIKE MR.ROGER MCGILL)THERE WERE NEVER ANY VIOLATIONS FOUND BY THESE AGENCIES!
MAY 2002,..... NYSOCFS MONITOR'S REMOVED PERSONAL & PRIVATE INFORMATION FROM STAFF FILES.
AUGUST 15, 2002....THE DAY CARE CENTER WAS FORCED INTO A STIPULATION OF SETTLEMENT AGREEMENT WITH THE NYSOCFS. IN ADDITION, PAYING A $1,500 FINE TO THE STATE. THE NYSOCFS REFUSED TO ALLOW OPERATON OF THE DAY CARE CENTER UNLESS THE THE STIPULATION OF SETTLEMENT WAS AGREED BY THE CENTER'S DIRECTOR. THE STATE GRANTED THE DAY CARE CENTER A 1 YEAR LICENSE PROBATION PERIOD, WITH ADDITIONAL STIPULATIONS PLACED ON THE LICENSE.
JULY 2003,.... NYSOCFS MONITOR/LICENSOR, TOMMY FINCH,.... HE WAS ASSIGNED TO THE ELAQUENCE DAY CARE CENTER. HE INFORMED THE DAY CARE DIRECTOR THAT HIS SUPERVISOR, PATRICIA HARPER DEMANDED THAT HE NOT COMPLETE A RENEWAL INSPECTION FOR ELAQUENCE DAY CARE CENTER, BECAUSE SHE WAS NOT GOING TO APPROVE A NEW LICENSE FOR THE CENTER. (IT WAS LATER LEARNED THAT MR. FINCH WAS NO LONGER EMPLOYED WITH THE NYSOCFS.)
AUGUST 2003,..... THE NYSOCFS BREACHED THEIR NORMAL LICENSE RENEWAL PROCEDURE TO THE DAY CARE CENTER.
AUGUST 2003,..... PUBLIC RECORDS REVEALED THE NYSOCFS PURPOSELY WITHHELD & CONCEALED CORRECTED VIOLATIONS INFORMATION, WITH THE INTENT TO KEEP THE ELAQUENCE DAY CARE CENTER OUT OF COMPLIANCE. IN CONCLUSION, NOT TO RENEW THE CENTER'S LICENSE.
AUGUST 2003,.... NYSOCFS DREW UP A SECOND STIPULATION OF SETTLEMENT FOR THE DAY CARE CENTER. THIS SETTLEMENT WAS DESIGNED BY THE NYSOCFS FOR THE SOLE PURPOSE INTENDED, PARALYZING THE OWNERS & THEIR BUSINESS RIGHTS TO UTILIZE THE SUPREME COURT FOR FAIR AND BALANCED TREATMENT UNDER THE LAW.
AUGUST 2003-APRIL 2004,.... THE DAY CARE CENTER OPERATED WITH A PENDING LICENSE, UP FOR RENEWAL. FORTY WORKING FAMILIES DEPENDED ON THE DAY CARE CENTER'S SERVICES.
APRIL 2004- JANUARY 2005,...... DAY CARE CENTER EXERCISED THEIR RIGHTS TO AN ADMINISTRATIVE HEARING FOR THE RENEWAL/DENIAL OF THEIR LICENSE. (HEARING JUDGE LA HAYE, LATER RETIRED)
JANUARY 2005,.... THE NYSOCFS ATTORNEY, EDWARD WATKINS, MAURA SPRATT, & OCFS HEARING JUDGE LA HAYE, ACCOMPANIED BY THE DIRECTOR OF THE DAY CARE CENTER, ELLA QUINN, AND HER ATTORNEY, RICHARD COLLINS SCHEDULED A VISIT INSIDE THE DAY CARE CENTER. THEY VOICED THEIR APPROVAL OF THE FACILITY.
THE JANUARY 2005 VISIT WAS USELESS, THE LIVELIHOOD OF THE DAY CARE CENTER WAS IN JEOPARDY, AN IT WAS PREDETERMINED TO DENY THE BUSINESS'S A LICENSE.
IN OCTOBER 2005,..... THE DAY CARE CENTER'S DIRECTOR, FINANCIALLY EXHAUSTED, COULD NOT AFFORD THE ORIGINAL ATTORNEY'S PREVIOUSLY HIRED. THE DAY CARE DIRECTOR HIRED NEW COUNSEL, WHO UNFORTUNATELY FILED AN UNTIMELY APPLICATION FOR AN ARTICLE 78.
DUE TO DRAINING FINANCES AND EXHAUSTING APPEALS IN ACCORDANCE WITH THE UNTIMELY ARTICLE 78 FILING. THE DAY CARE CENTER THAT HAD BEEN IN BUSINESS FOR OVER 20 YEARS, EMPLOYED MORE THAN 50 PEOPLE, WAS FORCED TO SHUT DOWN AND CLOSE IN JANUARY OF 2008. STAFF LOST THEIR JOBS AND FAMILIES WERE LEFT TO FIND OTHER MEANS OF CHILDCARE.
I AM CURRENTLY FIGHTING, STRUGGLING AND TRYING TO REBUILD MY FAMILY'S BUSINESS, THAT MY HUSBAND AND I WORKED SO HARD TO CREATE. AFTER ALL THAT HAS HAPPEN TO ME AND MY FAMILY REGARDING THE NYSOCFS' ABUSE OF AUTHORITY AND VENGEANCE , I STILL BELIEVE IN JUSTICE FOR ALL!
